2. Acceptance of Terms
By accessing or using ClearRide ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
3. Description of Service
ClearRide is a mobile application that provides route-based weather information specifically designed for motorcyclists. The App offers:
- Real-time weather conditions along your route
- Ride safety scores and risk assessments
- Departure time comparisons
- Route alternatives to avoid adverse conditions
- Weather-based route planning
4. Eligibility
You must be at least 16 years old to use ClearRide. By using the App, you represent and warrant that you meet this age requirement.
5. Subscriptions and Pricing
5.1 Subscription Plans
ClearRide offers the following subscription tiers:
- Free Tier: Basic route conditions with limited features
- Pro Tier: £3.99/month or £29.99/year with advanced features including departure comparisons, route alternatives, detailed timeline views, and unlimited saved routes
- 7-day free trial available for Pro tier
5.2 Payment and Billing
- Subscriptions are billed through the Apple App Store or Google Play Store
- Payments are processed by Apple or Google, not directly by ClearRide
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Refunds are handled according to Apple App Store or Google Play Store policies
5.3 Cancellation
You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation will take effect at the end of the current billing period.
6. User Responsibilities
6.1 Safe Riding
- Weather information is provided as a guide only
- You are solely responsible for your safety while riding
- Always assess road and weather conditions yourself
- Do not use the App while actively riding
- ClearRide does not replace your judgment or professional weather forecasts
6.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
7. Weather Data Disclaimer
7.1 No Warranty
Weather information is provided "as is" without any warranty of accuracy, reliability, or completeness. Weather conditions can change rapidly and unpredictably.
7.2 Third-Party Data
We use third-party weather data providers (Apple WeatherKit). We are not responsible for the accuracy or availability of this data.
7.3 No Liability for Riding Decisions
ClearRide is not liable for any decisions you make based on the weather information provided. You assume all risks associated with motorcycle riding.
8. Acceptable Use
You agree not to:
- Use the App for any illegal purpose
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's operation
- Use the App in any way that could damage, disable, or impair the service
- Reverse engineer, decompile, or disassemble any part of the App
- Use automated systems (bots, scrapers) to access the App
9. Intellectual Property
9.1 Ownership
ClearRide, including its design, code, content, and trademarks, is owned by Orber & Co. Ltd and protected by copyright, trademark, and other intellectual property laws.
9.2 License
We grant you a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use.
10. Limitation of Liability
To the fullest extent permitted by law, ClearRide and Orber & Co. Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the App
- Any unauthorized access to or use of our servers
- Any interruption or cessation of transmission to or from the App
- Any bugs, viruses, or the like that may be transmitted to or through the App
- Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the App
11. Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
